Legal dispute nearly closes The Cliffs Resort

Wed, 02/13/2019 - 12:00 am

An on going lawsuit nearly led to The Cliffs Resort closing their doors on Friday Feb. 8.

A lawsuit between The Cliffs Property Owners’ Association and Double Diamond Management Corporation, who run the resort, has been in the court system since the suit was filed July 5, 2017.

On Wednesday, Feb. 6, Double Diamond President and Chief Executive Officer Mike Ward sent out an email to property owners at The Cliffs informing them the resort would close on Feb.8. due to a court order to transfer all funds held by Double Diamond to the owners’ association.

“The effect of the court’s order, and the unwillingness of the association (under the direction of the new board), is that the operation of the facilities and amenities of The Cliffs can no longer be sustained and will close Feb. 8,” The email said.

The restaurant, hotel, spa, fitness center, golf course and pools would all be closed and no security would be on staff during the closure.

However, on Thursday, Feb. 7, Ward sent out another email informing the owners of an agreement reached between the POA and Double Diamond to keep the resort open through March 15.

“Double Diamond Management Company will continue managing the property during this interim period and the parties have agreed to mediate in an attempt to negotiate a permanent solution,” the email said.

The Lake Country Sun is still gathering more information about the ongoing dispute between the two sides and will provide more information in a future edition.
