A Breckenridge man was arrested and could face up to 99 years in prison for the manufacture or delivery of a controlled substance and violation of parole.
Stephens County Sheriff’s Office arrested Johnathan R. Wimberley on Wednesday, July 22 for manufacturing or deliver (possession with intent to deliver a controlled substance penalty group 1 equal to or more than 1 gram but less than 4 grams.
Wimberley is currently probation for engaging in organized criminal activities related to a methamphetamine drug-dealing ring in Breckenridge. Wimberley and 11 other individuals were indicted in April 2019 for conspiring together to transport, deliver, and sell the drug, according to the complaint and affidavit of probable cause for arrest.
If Wimberley was caught violating the terms of his probation, he could face up to 99 years in prison.
According to the Texas Health and Safety Code, Title six, subtitle C, of the Texas Controlled Substance Act, Penalty Group 1 includes the aggregate weight of any mixture, solution, or other substance containing a controlled substance. The crime is a state jail felony, punishable by a state jail sentence of not less than 180 days or more than two years.
On Wednesday, July 22, Wimberley was stopped by the SCSO driving with a suspended driver’s license. Upon search of his subject, the SCSO found a single yellow plastic baggy in his pant pocket.
While searching the victim, a small box that turned out to be a Marlboro cigarette box was found in the parking lot. Inside the box was what the SCSO later weighed to be approximately 1.6 grams of suspected methamphetamine.
The content inside the box also tested positive as methamphetamine. Also within the same cigarette box were other small yellow baggies exactly like the one in Wimberley’s pant pocket.
The subject was subsequently put under arrest for driving with a suspended license and manufacture or delivery of a controlled substance.
Wimberley was last arrested in March 2020 for Driving with an invalid license with previous convictions and for possession of drug paraphernalia.
Wimberley has been convicted twice for Possession of a Controlled Substance, Penalty Group 1, of less than 1 gram, once for the same offense equal to or more than one gram but less than 4 grams, and once for Possession of a Dangerous Drug.
